Watkins & Eager offers bellwether trial and extensive case management experience at lower cost than regional or national law firms. We use various fee structures, including fixed fees and hourly rates.
Our firm devotes substantial resources to the defense of pharmaceutical and medical device manufacturers. Nationally ranked in Product Liability by Chambers the past six years, we have handled over twenty separate pharmaceutical and medical device litigations. In several major drug product litigations, we have served on national and "virtual" teams as coordinating, law and motion, trial, and appellate counsel. We try cases; practice area members Walter Johnson and Mildred Morris have tried significant Mississippi pharmaceutical cases with national impact to directed or defense verdicts. Walter Johnson has been selected for trial teams in states outside Mississippi in a number of pharmaceutical cases which were resolved before or during trial. Doug Gunn has tried cases involving a genetically modified crop to verdict in Arkansas state courts. (See practice area descriptions for Automotive, Mass Torts and Repetitive Exposure, and Product Liability for additional bellwether and out of state trials by firm members Mike Ulmer and David Ayers.)
Mississippi has no state class action rule, and our firm has worked successfully to defeat de facto classes. We have been involved in diverse roles in numerous federal MDLs and state consolidated proceedings around the country, including those established for Baycol (national trial team), Genetically Modified Rice, HRT (national team), Mirena, PPA (national law and motion counsel), Rezulin, Thimerosal (co-national counsel), Trasylol, and Yaz/Yasmin, Stadol and Reglan. We have extensive experience in retaining and developing expert witnesses. We have developed unique, enduring relationships with many of the top medical experts through years of medical malpractice defense. We have prepared and defended dozens of company current and former employees, including executives, in depositions across the U.S. and in Asia and Europe.
We recognize the impact of high profile litigation on the client's business. We have managed large volumes of cases from discovery through trial in an efficient and cost effective manner. Our flexible framework of legal assistants, nurses, and lawyers may be tailored to the effective administration of individual cases as well as mass filings. We have supervised production and conducted quality control review of millions of pages of documents in several litigations, and we know the critical issues surrounding e-discovery and document management.
We would be pleased to provide client and co-counsel references upon request.
